Welcome to Black REwrite. This website is operated by Keyed Shifts LLC, doing business as Black REwrite (“Black REwrite”, “we”, “us”, “our”), 418 Broadway, Suite 5404, Albany, NY 12207. By using this website, creating an account, or making a purchase, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the site.

Acceptance of terms

Using the site, creating an account, or making a purchase means you accept these terms and our Privacy Policy. When you create an account or check out, you confirm your agreement by checking the box that links to this page.

Eligibility

You must be 18 years of age or older to create an account or make a purchase. We do not knowingly allow accounts for anyone under 18.

Your account

You are responsible for the activity on your account and for keeping your password private. Tell us right away at support@blackrewrite.com if you believe your account has been used without your permission.

Membership and the ReWriter community

Members can build a public ReWriter profile and share writings, books, and events. Membership may be offered on a recurring plan. The recurring price, the billing frequency, and how to cancel are shown to you before you pay and are described in our Refund and Returns Policy. Your use of the community is also governed by the Community Standards below.

Community standards

To keep this a safe and respectful space, the following are not allowed anywhere on the site: hate speech, harassment, bullying, threats, sharing private information about others, spam, fraud, sexual content, illegal content, and pretending to be someone you are not. We may remove content or accounts that break these standards.

Your content and the rights you keep

You keep ownership of the work you create and submit. By submitting content, you confirm that you created it or that you have the right to share it.

The license you give Black REwrite

So that we can run the community, you give Black REwrite a license that is nonexclusive, royalty free, and worldwide to host, display, format, and promote the content you submit. This license ends when you remove your content, except for archival copies and for promotion that was already shared.

Originality and AI

Work you submit must be your own. Plagiarism and stolen work are not allowed. If you use AI tools to assist your work, the result must still meet these originality rules. You are responsible for verifying facts and citations and for holding all rights to what you submit.

Copyright and DMCA

We respect copyright and respond to valid notices under the Digital Millennium Copyright Act. If you believe content on the site infringes your copyright, send a notice with the required details: your contact information, a description of the work, the location of the material on our site, a statement of good faith belief, a statement that the information is accurate, and your signature. You can start a copyright notice through our Report a Problem page, and we will route it to our designated agent. If your content was removed and you believe that was a mistake, you may send a counter notice. We end the accounts of people who infringe repeatedly.

Editorial review

Submissions are reviewed by our editors before they go live. This review is for formatting, quality, and community standards only. It is not legal review, fact checking, copyright verification, or an endorsement. We curate at our discretion, and publishing your work is not an endorsement of it.

Purchases and payment

Purchases of merch, books, and courses are completed through our secure checkout and our payment processors. Prices, products, and availability can change at any time. Sales tax is applied where it is required. Refunds and returns are governed by our Refund and Returns Policy.

Courses and educational disclaimer

When you enroll in a course, access is granted to your account for your own personal use. Please do not share, resell, copy, or redistribute course materials. Our courses and workshops are educational. We do not guarantee publication, an agent, income, book sales, representation, or any particular result. Your results depend on your own effort.

Intellectual property

The Black REwrite name, logo, site design, and original site content belong to Black REwrite or its licensors. Members keep ownership of the work they create and submit, subject to the license described above.

Acceptable use

You agree not to use the site in any way that is unlawful, harmful, or abusive, and not to interfere with how the site works for other people. The Community Standards above also apply.

Suspension and termination

We may suspend or end an account and access to the site at our discretion, for example if these terms are broken. If your access ends, your right to use the site stops, and content may be removed in line with this agreement.

Third party links and marketplace

The site may link to other websites that we do not control, and we are not responsible for them. Black REwrite is not a party to transactions between members, such as books, services, events, or coaching that members arrange with one another.

Disclaimer of warranties

The site and its content are provided on an as is and as available basis. To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, and noninfringement, and we do not guarantee that the site will be uninterrupted or free of errors.

Limitation of liability

To the fullest extent allowed by law, Black REwrite is not liable for indirect, incidental, or consequential losses that arise from your use of the site. Our total liability is limited to the amount you paid to us in the twelve months before the claim.

Indemnification

You agree to cover claims, losses, and costs that arise from your content, your conduct, or your violation of the law or the rights of others.

Governing law and venue

These terms are governed by the laws of the State of New York, United States. Disputes will be heard in the state or federal courts located in New York.

Force majeure

We are not responsible for delays or failures caused by events outside our control, such as outages of our payment processor, host, email service, or video service.

Electronic communications

You agree that we may send you notices and other communications electronically, including by email and through your account.

Changes to these terms

We may update these terms from time to time. When we make a material change, we will post notice here. The updated version takes effect once it is posted, and your continued use of the site means you accept it.

Other terms

If any part of these terms is found not to apply, the rest still applies. These terms are the entire agreement between you and Black REwrite about the site. We may assign these terms as part of a business change. A delay in enforcing a term is not a waiver of it. Terms that by their nature should continue will survive the end of your account. Any claim must be brought within one year. Headings are for convenience only.
